Construction Bureaus (or Construction Committees) of all cities and counties (city-level), Taizhou Municipal Administration of Construction Engineering, and relevant provincial departments and bureaus.
To further standardize the qualification approval process for construction engineering enterprises in our province and strictly enforce market access management in the construction sector, in accordance with the spirit of the “Notice from the General Office of the Ministry of Housing and Urban-Rural Development on Strengthening the Verification of Performance Records Submitted by Construction Engineering Enterprises” (Jianban Shi [2012] No. 36), and taking into account the actual situation of qualification approval for construction engineering enterprises in our province, we hereby issue the following notice on strengthening the verification of performance records submitted by such enterprises:
I. Scope and Main Contents of Performance Verification
(1) Scope of Verification: All enterprises applying for the first time, upgrading, or adding items to their qualifications for surveying, design, construction, supervision, bidding agency, or integrated design-and-construction services—whether such applications are submitted for approval or preliminary review by the Provincial Department—must undergo performance verification prior to qualification review.
(2) Verification Types: 1. Project performance completed by the enterprise itself, as required by the enterprise qualification standards (hereinafter referred to as “enterprise performance”);
2. The engineering achievements completed by the company’s qualified technical personnel as required in the enterprise qualification standards (hereinafter referred to as “individual achievements”).
(3) Main Contents of the Verification: 1. Enterprise Performance: The verification primarily focuses on the completion status of performance targets, start and completion dates, project costs, standard assessment indicators, engineering quality, and safe production conditions.
2. Individual Performance: Primarily verifies the roles played by professional and technical personnel in engineering projects, the entities that have achieved their performance targets, the timing of performance completion, the scale of performance, and safety production conditions.
(4) Verification Materials 1: Performance of surveying and design enterprises—verify the following materials:
(1) Engineering survey or engineering design contracts. For performance reports covering survey and design projects undertaken in this province after October 1, 2010, it is also necessary to verify the “Jiangsu Province Construction Project Survey and Design Contract Filing Form,” which has been reviewed and approved by the construction administrative authority of the project’s location.
(2) The completion, handover, and trial operation certification documents issued by the construction unit (owner), or the project completion acceptance documents;
(3) The project’s survey report or the title blocks of the main design drawings;
(4) For projects reported as involving engineering surveys, architectural engineering, or municipal engineering, it is also necessary to verify the review opinion letter and the certificate of approval for the project’s construction drawings. With regard to the performance records of survey and design personnel, in addition to the materials that should be verified for the performance records of the survey and design firms mentioned above, relevant supporting documents from the project completion unit must also be reviewed, along with the signature of the individual on the key design drawing title blocks or survey reports.
2. For construction and design-integrated enterprises, verify the following materials:
(1) Notice of Award (Construction Permit);
(2) The construction contract (specialized subcontracting construction contract) that has been filed and registered;
(3) Completion and Acceptance Filing Documents for the Project. For projects that, in accordance with the law, are not required to undergo bidding, the Notice of Award may be omitted. The design performance submitted by integrated design-and-construction enterprises and their personnel shall be verified using the same materials required for survey and design enterprises and their personnel.
3. Performance of engineering supervision enterprises—verify the following materials:
(1) Supervision Contract;
(2) Supervision Plan;
(3) Supervision Work Manual;
(4) Completion and acceptance documents for the project.
4. Performance of engineering bidding agency enterprises—verify the following materials:
(1) Engineering Procurement Agency Entrustment Contract;
(2) Notice of Award for the Project Undertaken by the Agent;
(3) Evaluation opinion form from the project client (the notice of award or evaluation opinion form shall bear the official seal of the competent authority);
(4) Project approval documents. For performance reports submitted by survey, design, construction, integrated design-construction, supervision, and bidding agency firms for projects located outside the province, in addition to providing the materials listed above, they must also submit relevant certification documents issued by the provincial-level construction administrative authority of the project’s location.
II. Performance Verification Procedures
(1) Before conducting the initial review of construction enterprise qualifications, the construction authorities of each city and county (city) shall be responsible for organizing verification of the enterprises’ performance and the performance records of the entities that have completed individual projects. If the performance reported by an enterprise is located outside its own administrative region, the construction authority where the enterprise is registered shall carry out the cross-regional verification and affix the official seal of the construction authority in the location where the performance was completed.
(2) For enterprises whose applications are approved by the provincial department, before the Administrative Approval Office of the provincial department accepts the application, the relevant business divisions shall be responsible for verification: for surveying and design firms, the Verification shall be handled by the Department of Building Energy Conservation and Scientific Research & Design; for construction and supervision firms, the Verification shall be handled by the Department of Building Market Regulation; for integrated design-and-construction firms, the Verification shall be conducted separately by either the Department of Building Energy Conservation and Scientific Research & Design or the Department of Building Market Regulation, depending on the type of performance reported; for bidding agency firms, the Verification shall be handled by the Provincial Bidding Office. For enterprises whose applications are initially reviewed by the provincial department, the Verification of performance reported by enterprises operating across provincial administrative regions shall be conducted by the Ministry of Construction.
(3) The verification of performance within the province shall not exceed 15 working days; the verification period shall not be counted toward the statutory time limit for administrative licensing.
(4) When submitting enterprise qualification application materials, each city and county (city) shall provide the “Summary Table for Verification of Enterprise Performance in Construction Engineering Enterprise Qualification Applications” (Attachment 1), stamped with the official seal, as well as the “Summary Table for Verification of Individual Performance in Construction Engineering Enterprise Qualification Applications” (Attachment 2). Attached to the summary tables shall be individual performance verification forms for each project undertaken by the applicant enterprise (Attachments 3–5). Each individual performance verification form must be stamped by the construction administrative authority of the location where the performance was achieved.
(5) The enterprise performance and individual performance submitted by construction engineering enterprises will be publicly disclosed simultaneously on the provincial department’s website when the approval and public notice opinions are released (for those applying for integrated construction and design qualifications, the disclosure will also be synchronized on the provincial construction industry website), thereby subjecting them to public oversight.
III. Supervision and Management
(1) Construction enterprises shall actively cooperate with the performance verification efforts organized by construction authorities at all levels, truthfully provide the relevant materials, and assume responsibility for the authenticity of such materials.
(2) Regarding performance verification conducted in a different jurisdiction, construction authorities in various regions shall cooperate with each other and provide written feedback on the verification results within 15 working days after receiving the inter-jurisdictional verification letter.
(3) If construction authorities at all levels discover, during performance verification, that a construction enterprise has engaged in fraudulent practices, they shall handle the matter in accordance with the “Measures for Handling Fraudulent Practices in the Application for Construction Enterprise Qualifications” (Jianshi [2011] No. 200), and shall file the outcome of the handling with the relevant business department of the provincial department for record.
(4) With regard to the performance verification results for construction enterprises issued by the construction administrative authorities of various cities and counties (city-level), the relevant business divisions of the Provincial Department will conduct spot checks. Any entity found, upon verification, to have failed to conduct thorough verifications, issued false verification opinions, or failed to provide feedback on verification results within the prescribed time frame will be publicly criticized throughout the province. If the Provincial Department’s verification or spot checks reveal that a construction enterprise has engaged in fraudulent activities, its application will not be granted administrative approval; its applications for qualification upgrades and additional scopes of work will not be accepted for one year; and the case will be publicized on the Provincial Department’s website and recorded on the provincial credit supervision platform.
4. Other: Construction authorities at all levels must attach great importance to the verification of performance records submitted by construction enterprises for qualification and licensing purposes. They should establish internal checks and balances, clearly designate responsible leaders, implementing agencies, and personnel, and earnestly fulfill their responsibilities. By November 23, 2012, they should uniformly submit to the Provincial Department the names and contact information of the staff members in charge of performance record verification for each specialty in their respective regions (Attachment 6).
